Abstract
Selon l'opinion majoritaire, devant le silence du législateur, un conseil d'arbitrage ne peut inférer que la période d'un an fixée à l'article 4 de la Loi des Différends entre les Services publics et leurs salariés, pour la durée d'une sentence arbitrale fixant les conditions de travail, doit s'ajouter à tout le délai écoulé depuis l'expiration d'une convention antérieure, quelle que soit la longueur de ce délai. Selon l'opinion minoritaire, il n'existe aucune interdiction légale dans notre législation ouvrière, en matière de rétroactivité. La rétro-activité est devenue une coutume en matière de négociations collectives depuis le début de la dernière guerre mondiale.
