Cet article présente un regard croisé sur les modalités par lesquelles les juridictions canadienne et européenne (Cour européenne des droits de l’homme) esquissent les grandes lignes d’une jurisprudence hésitante sur la place à accorder aux symboles religieux portés par des usagers du système de la justice. L’article montre d’abord qu’au Canada, les juridictions soutiennent une vision libérale de la laïcité qui, tout en réaffirmant fortement la garantie de la liberté de conscience et de religion des citoyens, est plus mitigée quand il s’agit de la concilier en cas de conflit avec d’autres droits, notamment celui à un procès équitable des autres parties. L’article révèle ensuite que la Cour européenne des droits de l’homme, par des arrêts où elle condamne pourtant des États pour une restriction excessive du port de signes religieux dans l’enceinte d’un tribunal, donne néanmoins à ceux-ci les clefs pour instituer pareilles interdictions de manière conforme à la Convention.
