Abstract
- A presente pesquisa foi realizada durante o período de estágio de doutorado sanduíche, na University of Ottawa, no período de julho de 2012 a fevereiro de 2013, tendo como objetivo central a verificação do funcionamento dos mecanismos judiciais de enfrentamento/tratamento da violência contra a mulher no Canadá. Para a coleta de dados, foi utilizada a análise de documentos oficiais do governo canadense, bem como pesquisa bibliográfica. A pesquisa permitiu identificar o fluxo de processamento dos casos de violência contra a mulher pelo sistema de justiça canadense, com as diferentes possibilidades de encaminhamento do agressor. Com base nos dados levantados, e em análises desenvolvidas por pesquisadores canadenses sobre o tema, é possível afirmar que, ainda que haja um grande investimento do governo canadense e a forte articulação entre instituições de diversos âmbitos estatais, os índices referentes aos conflitos violentos conjugais não apresentam uma queda significativa. Neste sentido, parece ser razoável apontar a dificuldade do sistema penal em dar conta de conflitos desta natureza, uma vez que a leitura criminalizante apresenta uma série de obstáculos para a sua compreensão e intervenção.
