Abstract
Au Québec, les personnes malades ou dites en perte d’autonomie se sont vu reconnaître différents droits. Mais cette reconnaissance formelle ne nous dit pas comment ces droits sont compris et appliqués dans la pratique quotidienne, ni de quelle façon ils changent les rapports entre les soignants et les soignés. Nous dégageons quatre grands types d’interprétation que l’on donne des droits dans les établissements de santé et de services sociaux du Québec, au sein d’instances chargées d’en assurer le respect. Ces différentes interprétations des droits sont liées à autant de rapports différents que la personne malade peut établir avec les soignants, et de positions différentes qu’elle peut occuper au sein des établissements. L’analyse des droits nous conduira ainsi à la question du sujet.
