Abstract
Anthropologists who study intellectual property (IP) emphasize processes of commodification, relationships between IP and its others (those to whom historically it did not extend, whose creative efforts it fails to recognize, or who challenge and defy it), and the characteristic subject positions IP affords. Early scholarship emphasized IP's restriction of cultural expression, access to resources, and scientific inquiry. Later critical analysis of liberal IP discourse led to transformations in disciplinary research practice. Processes through which “traditional” goods are recognized by IP, interpretation of IP by non‐Western others, practices of translation by which traditions are recognized, and the activities of those who actively resist IP are lively areas of inquiry, as are the subjectivities that IP discourse and practice constitute. The extension of IP to genetic resources, traditional knowledge, and traditional cultural expressions promises to foster the articulation of new forms of collective identity and contestation.
