Abstract
Par la présente étude, nous démontrons, dans un premier temps, qu’un jugement portant sur l’application de l’article 15(1) de la Charte canadienne des droits et libertés à un programme social particulier risque d’avoir un impact considérable sur l’ensemble du système de sécurité sociale canadien. À cette fin, nous évaluons, dans le contexte de l’article 15 de la Charte, les répercussions potentielles de cinq décisions récentes relatives au programme canadien d’assurance-chômage sur trois autres programmes sociaux fédéraux, à savoir le Régime de pensions du Canada, la Loi sur la sécurité de la vieillesse et la Loi de l’impôt sur le revenu du Canada. Dans un deuxième temps, nous analysons la réaction des tribunaux à l’égard des principales justifications que le gouvernement fédéral invoque à l’appui de ses programmes sociaux, dans le cadre de l’article 1 de la Charte. Nous constaterons alors une nette tendance des tribunaux à s’en remettre au législateur ou à se déclarer institutionnellement incompétents quand des législations socio-économiques sont en cause.
