Abstract
Un tribunal d'arbitrage décide, à la majorité, qu'il ne peut suppléer à la convention en fixant lui-même la durée du délai d'avis pour des périodes de repos devant être "fixées à l'avance", alors que la clause de la convention ne le détermine pas elle-même. L'arbitre syndical soutient que même si la disposition contractuelle accorde à l'employeur une discrétion pour fixer le délai, celui-ci ne peut l'exercer d'une manière arbitraire et que le tribunal est compétent pour fixer ce délai selon l'équité et la bonne conscience.
