Abstract
Entre la fin du XIXe siècle et les années 1950, l’Amérique du Nord (États-Unis et Canada) et la plupart des pays d’Europe réforment leur système juridique et se dotent d’institutions judiciaires et socio-éducatives nouvelles afin de prendre en charge de façon spécifique les jeunes délinquants. Ces justices des mineurs ont bien sûr leurs particularités nationales. Des traditions juridiques très différentes (common law vs droit romano-germanique), des organisations étatiques contrastées (fédéraliste vs centralisme « jacobin »), des systèmes politiques plus que variés (régimes autoritaires voire totalitaires vs démocraties libérales) nonobstant des conditions économiques, démographiques, sociologiques nullement équivalentes ne pouvaient déboucher sur un droit pénal des mineurs uniforme. Pour autant les premières recherches comparatives n’ont pas manqué de souligner un certain nombre de points communs à toutes ces législations. De l’Espagne au Portugal, du Canton de Vaud au Canada, les articles réunis dans ce numéro, issus d’un colloque international, Naissance et mutations de la justice des mineurs, organisé à l’université d’Angers, sont à lire comme une contribution à cette histoire comparée.
