Abstract
The first federal insolvency statute in Canada dates back to 1869. It provided for voluntary and forced bankruptcy. The Insolvent Act of 1869, however, only applied to traders. An amended version of the former was enacted in 1875, but it was repealed in 1880, shortly after a depression, due to public resentment: people felt that the Act was used too often as a means to defraud creditors, instead of as a means of relief for honest debtors. It took almost 40 years before the federal Parliament enacted a new statute; in 1919, the Bankruptcy Act was enacted. The Act of 1919 was drafted in such a way as to create a creditor-controlled bankruptcy framework.
