Abstract
Kanada und Deutschland sind beides föderale Staaten und doch geprägt von Unterschieden in der Staatsorganisation. Der Föderalismus als Verfassungsrealität erlaubt ein weites Spektrum von Alternativen hinsichtlich der Rolle des politischen Zentrums und der Autonomie der Gliedstaaten. Die Skala föderaler Verfassungen und ihrer Praxis umfasst ganz unterschiedliche Ausprägungen. Ein Endpunkt der Skala ist der unitarische Bundesstaat, wie er sich in Deutschland herausgebildet hat. Am anderen Ende der Skala steht der dezentralisierte Bundesstaat. Er wurde in Kanada nicht zuletzt als Folge des Kampfes um eine zeitgemäße Form des Föderalismus in Reaktion auf die „stille Revolution“ in Québec verwirklicht. Während in Deutschland mit dem Schlagwort „Einheitlichkeit der Lebensverhältnisse“ Alleingänge der Gesetzgebung und Politikgestaltung in den Ländern unter Rechtfertigungszwang geraten – man denke nur an die Kritik am Bildungsföderalismus –, werden in Kanada vom Bund ausgehende Vereinheitlichungstendenzen in den meisten Provinzen, nicht zuletzt in Québec, mit großem Misstrauen beobachtet. Einschränkungen der Provinzrechte gelten als Angriff auf die Eigenständigkeit der Gliedstaaten, die als höheres politisches und gesellschaftliches Gut gesehen wird als das Ziel einer gesamtkanadisch umfassenden Gleichstellung aller Staatsbürger.
