Abstract
The Naït-Liman v. Switzerland case raised the issue of whether a member state of the Council of Europe had to hear a compensation claim filed by a permanent resident in respect of alleged torture in Tunisia at the instigation of a foreign official. This case is of great significance, for the right of access to a court conflicts with the well-established principle of jurisdictional immunity under international law. The European Court of Human Rights upheld its previous case law, dismissed both the universal civil jurisdiction and forum of necessity claims, and eventually concluded that the restriction of the right of access to court should remain proportional. Such an outcome could however be debated in the light of both the particular aspects of the case at hand and an evolving debate about established case law.
