Abstract
La retenue obligatoire pour tous les employés d'une somme égale à la cotisation fixée par le syndicat pour ses membres (Formule Rand) constitue une « condition de travail » au sens de la loi, donc peut faire l'objet de négociation entre le syndicat et la compagnie. Là où elle est négociée, elle constitue une clause valide et obligatoire. La loi ne permet pas de distinguer entre clauses normatives des conditions de travail et conditions de travail conventionnelles. La Formule Rand est aussi réglementaire des relations patronales-ouvrières que n'importe quelle autre clause dans une convention collective, car elle se rapporte directement au contrat de travail. Elle n'est pas défendue par la loi, cette dernière ne voulant pas rendre applicable le principe du mandat.
