Abstract
Qanun al-Ahkam pada dasarnya adalah sebuah upaya untuk memilih pendapat yang lebih mashlahat tentang suatu hukum pada suatu negara dan waktu tertentu yang dianggap memiliki daya mashlahat yang lebih besar demi kepentingan masyarakat secara luas. Untuk itulah peran penguasa dalam hal ini adalah para pembuat konstitusi negara yang mempunyai wewenang untuk membuat qanun tersebut. Dalam hukum Islam hal tersebut diatur dalam ilmu siyasah dusturiyah yakni siyasah yang mengatur hubungan warga negara dengan lembaga negara yang satu dengan warga negara dan lembaga negara yang lainnya dalam batas-batas administrasi negara. Qanun al-Ahkam merupakan wilayah dalam permasalahan tentang pengaturan dan perundang-undangan yang dituntut oleh hal ihwal kenegaraan dari segi persesuaian dengan prinsip-prinsip agama dan merupakan realisasi kemashlahatan manusia serta memenuhi kebutuhannya.
