Abstract
تبحث هذه الدراسة في القرار المشترك لكل من الحكومتين الكندية والهولندية المتمثل برفع دعوى متعلقة بمسؤولية الحكومة السورية عن الإخلال بالتزاماتها الدولية بموجب اتفاقية مناهضة التعذيب، وغير ذلك من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة. وترى أن هذه الخطوة مهمة لثلاثة أسباب على الأقل: أولها، مواصلة الضغط على الحكومة السورية وتذكيرها بأن انتهاكاتها الصارخة لحقوق الإنسان، بما في ذلك تعذيب الكثيرين حتى الموت في السجون، لن تُنسى من جهة الدول الملتزمة بنظام دولي، والمصممة على محاسبتها مهما امتد أمد الصراع. وثانيها، أنّ ذلك الإجراء قد يُحفز، أو يُجبر، الحكومة السورية على اتخاذ إصلاحات دستورية وتشريعية تتماشى مع التزاماتها، بموجب اتفاقية مناهضة التعذيب، ومحاسبة مرتكبي أعمال التعذيب. وثالثها، أن تحرك كندا وهولندا خارج عن نطاق استعمال حق النقض في مجلس الأمن التابع للأمم المتحدة من جانب حلفاء الحكومة السورية، ومن ثم فهو فرصة لبذل المزيد من الجهد لفتح سجل الحكومة أمام التدقيق الخارجي لانتهاكاتها حقوق الإنسان. وتخلص الدراسة إلى أن تحرك كندا وهولندا يقع على نحو صحيح في مجال أو مبدأ "مسؤولية الدولة"، وأنه لا ينبغي الخلط بينه وبين التحرك بموجب نظام روما الأساسي لمعاقبة الأفراد الذين يرتكبون جرائم ضد القانون الدولي؛ مثل جرائم الحرب، والجرائم ضد الإنسانية، والجرائم ضد مقاصد الأمم المتحدة.
