Abstract
Le 2 septembre 1941, Paul Didier est le seul magistrat à refuser de prêter serment de fidélité au maréchal Pétain. Il est arrêté, révoqué et interné au camp de Châteaubriant avant d'être assigné à résidence. Cet acte courageux et d'une grande force symbolique n'est pas le seul engagement de cette forte personnalité tout au long de sa carrière, dans un parcours au service des valeurs de la justice. Mais, ce jour-là, le refus public du juge Didier de prêter serment, contrairement à une version reconstruite après-guerre, n'est pas concerté avec les quelques magistrats résistants qui eux prêtent serment afin de pouvoir continuer leur lutte clandestine.
