Abstract
ABSTRAK Penelitian ini bertujuan untuk memberikan rekomendasi kepada pihak pemerintah c.q dinas perhubungan atau pihak-pihak terkait terhadap adanya ketidaktaatan pembayaran overdimension overloading driver kendaraan yang berimplikasi pada kerusakan jalan alternatif desa. Relevansi penelitian ini memberikan dampak yang signifikan terhadap pendapatan negara juga menjadikan keresahan di lingkungan masyarakat yang terdampak Sebagaimana Peraturan Perundang-undangan No. 32 Tahun 2009 pasal 67 terkait dengan kewajiban melestarikan lingkungan hidup. Penelitian ini menggunakan metode yuridis normatif yang menekankan pada studi law in book diantaranya menggunakan bahan literatur buku-buku, jurnal-jurnal, peraturan-peraturan dan sebagainya. Selain itu juga menggunakan metode yuridis sosiologis atau empiris yaitu melalui pengamatan di lapangan. Urgensi perlunya pengawasan terhadap muatan angkutan barang perusahaan wajib mematuhi ketentuan yang berlaku Sebagaimana Peraturan Menteri Perhubungan Republik Indonesia Nomor 60 Tahun 2019 tentang penyelenggaraan angkutan barang dengan kendaraan bermotor di jalan pasal 71 ayat 1. Sehingga harus ada upaya dari pemerintah untuk meminimalisir terjadinya potensi penyalahgunaan jalan alternatif desa. Kata kunci: Desa; Jalan; Lingkungan; Overdimension Overloading; Pemerintah ABSTRACT This study aims to provide recommendations to the government, c.q. the transportation agency or related parties, for non-compliance with payments for overdimension overloading of vehicle drivers which have implications for damage to alternative village roads. The relevance of this research has a significant impact on state income and also creates unrest in the affected community. 32 of 2009 article 67 is related to the obligation to preserve the environment. This research uses a normative juridical method that emphasizes law in book studies including using literature, books, journals, regulations and so on. In addition, it also uses sociological or empirical juridical methods, namely through field observations. The urgency of the need for supervision of cargo transportation companies must comply with applicable provisions As the Regulation of the Minister of Transportation Republic of Indonesia Number 60 of 2019 concerning the implementation of goods transportation by motorized vehicles on the road article 71.
