Abstract
L’objectif du présent article est de contribuer au dialogue intersectoriel liant le droit de la preuve avec l’interprétation des lois. Il propose une analyse des pouvoirs attribués au gouvernement et au ministre de la Santé et des Services sociaux afin de prendre des décrets et des arrêtés ministériels en droit administratif. Basée sur de très larges délégations de pouvoirs discrétionnaires, l’interprétation des dispositions législatives prend d’abord ses assises sur la présomption d’application de la norme de la décision raisonnable établie dans l’arrêt Canada (Ministre de la Citoyenneté et de l’Immigration) c. Vavilov et la méthode moderne d’interprétation. S’agissant de dispositions législatives qui donnent peu d’emprise à l’interprète, la preuve factuelle joue à l’occasion un rôle décisif. Trois types de faits sont examinés — les faits en litige, les faits sociaux et les faits législatifs — et ils sont mis en rapport avec des motifs d’invalidité en droit administratif : les attentes légitimes, l’acte arbitraire et la mauvaise foi.
