Abstract
L’accès à la terre est l’une des principales revendications des peuples autochtones car la terre fait partie de leur identité et garantit leur développement en tant que groupe. Tous les instruments internationaux relatifs aux droits des peuples autochtones font référence à la relation spéciale qui existe entre les peuples autochtones et la terre. Afin de reconnaître les particularités et les besoins des autochtones, la Cour interaméricaine des droits de l’Homme a interprété l’article 21 sur le droit de propriété en y intégrant les caractéristiques de la propriété telle que conçue par les peuples autochtones. La Cour a enrichi son contenu et développé des obligations concrètes que l’État doit satisfaire pour se conformer à la Convention américaine relative aux droits de l’Homme et rendre effectif le droit à la propriété pour ces groupes.
