Abstract
Le standard de traitement juste et équitable (TJE) n'échappe pas au récent mouvement de réaffirmation de l’État dans le cadre de la protection conventionnelle des investissements étrangers. Cette contribution rappelle la principale difficulté rencontrée en pratique par les premiers tribunaux arbitraux amenés à interpréter des clauses de TJE (I) avant de s'intéresser à la rédaction singulière employée pour le TJE dans l'Accord économique et commercial global (AECG) récemment conclu entre le Canada et l'Union européenne (II). Il s'agit ainsi d’analyser la nouvelle rédaction et de voir dans quelle mesure cette dernière vient réellement limiter la portée du TJE accordé aux investisseurs canadiens et européens.
