Abstract
“Kyoto Protokolü’ne Uygunluk Usulleri ve Mekanizmaları”, 2005 yılında Montreal’de, Kyoto Protokolü Birinci Taraflar Toplantısı’nda kabul edilmiş, Sağlayıcı Dal ve Zorlayıcı Daldan oluşan Uygunluk Komitesi, 2006 yılında çalışmalarına başlamıştır. Sağlayıcı Dal tarafından kullanılan yetkiler, Montreal Protokolü başta olmak üzere, çeşitli çevre andlaşmalarında yer alan, Uygunluğun Sağlanması Usullerine benzemektedir. Kyoto Protokolü Uygunluk Mekanizması’nı ilginç kılan, Zorlayıcı Dal tarafından kullanılan yargı-benzeri yetkilerdir. İklim değişikliği rejiminin, ikinci yükümlülük döneminde -2012 sonrasında- ne gibi özellikler taşıyacağı, dolayısıyla Kyoto Protokolü Uygunluk Mekanizması’nda ne türden değişiklikler yapılması gerekeceği, şu an için belirsiz olmakla birlikte, Uygunluk Komitesi’nin mevcut yapı ve özelliklerinin; kullandığı yetkilerin; verilen kararların hukuksal nitelik ve sonuçlarının incelenmesi, ilerdeki uygulamaların daha sağlıklı zeminlerde yürütülmesini açısından gereklidir.
