Abstract

Cet article porte sur le suivi de personnes préalablement déclarées inaptes à subir leur procès ou criminellement non responsables en raison de troubles mentaux. Au Québec, depuis 1992, ce suivi revient à une instance du tribunal administratif dont les décisions, centrées sur une évaluation des risques pour la sécurité publique, peuvent aboutir à une libération des personnes ou à leur détention à l’hôpital. En nous appuyant sur une enquête ethnographique, nous décrivons la Commission comme un dispositif de contrôle (et d’autocontrôle) au sein duquel la voie médiane de la libération sous conditions joue un rôle pivot. Les pratiques des avocats de la défense, marquées par la prégnance d'une posture paternaliste, témoignent alors de la force d’un dispositif susceptible d’imposer sa logique jusqu’à ses acteurs a priori les plus adverses.
