Abstract
Dans cet article, l’auteur décrit le phénomène juridique qu’il définit comme une « rhétorique constitutive ». Plutôt que de voir le droit comme un système de règles et de processus bureaucratiques, il suggère que celui-ci est plus utilement vu comme une branche de la rhétorique, l’art qui crée et gère toutes nos sociétés. Une telle conception du droit permet aux juristes et non-juristes d’en faire une critique selon des normes éthiques et esthétiques, en posant des questions telles que : cela reflète-t-il vraiment qui nous sommes et la manière dont nous voulons vivre les uns avec les autres ? S’inspirant de la philosophie grecque, de la poésie classique et de l’œuvre de Ludwig Wittgenstein, l’auteur invite le lecteur à un voyage pour découvrir un nouveau rapport au droit ancré dans la créativité et la persuasion plutôt que dans la seule autorité.
