Abstract
Un paradoxe marque le statut du consommateur moderne. Si l’on peut percevoir ce dernier comme un sujet requérant la protection législative de l’État, en tant que victime potentielle de pratiques abusives, on reconnaît dans le même temps qu’il est doté d’un pouvoir régulateur découlant de l’élargissement de la gamme des informations sociétales accessibles. Deux questions retiennent ainsi l’attention de l’auteur : 1) L’adjonction, à la nature essentiellement protectrice du droit de la consommation, d’un pouvoir renforcé de régulation aux consommateurs soulève-t-elle un problème de cohérence juridique ? 2) Un droit étatique d’accès aux informations de type sociétal des consommateurs devant les entreprises de production et de vente devrait-il se fonder sur une politique de transparence inconditionnelle ? L’expérience du droit du travail et du droit consumocratique en Asie du Sud, dans la lutte contre le travail des enfants, offre une leçon de cohérence et de prudence en guise de réponse.
