Il y a quarante-cinq ans, le Parlement du Canada entérinait la Convention de la Baie James et du Nord québécois ( CBJNQ) en adoptant la Loi sur le règlement des revendications des autochtones de la Baie James et du Nord québécois. La loi fédérale énonce que la « présente loi éteint tous les revendications, droits, titres et intérêts autochtones, quels qu’ils soient, aux terres et dans les terres du Territoire, de tous les Indiens et de tous les Inuit, où qu’ils soient [...] ». Or, au moment de la signature de la CBJNQ , d’autres peuples que ceux qui l’ont négociée et signée revendiquent des droits ancestraux sur le territoire « conventionné ». Ils s’opposent à la loi fédérale notamment au motif que leurs droits ancestraux bénéficient d’une protection constitutionnelle en vertu de l’ Arrêté en conseil de sa Majesté admettant la terre de Rupert et le Territoire du Nord-Ouest de 1870 qui a initialement rattaché au Canada les terres par la suite annexées au Québec et aujourd’hui comprises dans le territoire conventionné. Le présent article a pour objet de vérifier le bien-fondé de cette thèse. Après avoir retracé la genèse juridique de l’annexion au Canada du territoire concerné, et précisé la portée constitutionnelle des conditions de cette annexion qui concernent les peuples autochtones, l’auteur en arrive à la conclusion que la Loi fédérale de 197 7 va à l’encontre de la condition 14 de l’arrêté impérial de 1870. Il fait valoir que l’extinction unilatérale des droits ancestraux des peuples non signataires n’est pas conforme à l’honneur de la Couronne qui est engagé par cette condition.
