Abstract
Selon les recherches de terrain, notamment québécoises, le néolibéralisme se traduit par la judiciarisation de la pauvreté par les droits pénal et social. Or, les implications de cette gestion néolibérale de la pauvreté restent à documenter en droit privé. Une telle entreprise apparaît particulièrement importante pour le droit de la consommation compte tenu de la transformation progressive des droits sociaux en dettes sociales, puis en dettes privées. Dans le présent article, l’autrice entame cette réflexion à partir d’une analyse de la tension entre l’exclusion et la « surinclusion » des personnes pauvres en ce qui concerne l’accès au crédit en soutenant que cette tension prend sa source dans des dynamiques conjointes de visibilité et d’invisibilité de la pauvreté, spécialement par l’entremise du droit. Or, celui-ci a besoin de mieux cartographier ces dynamiques afin d’encadrer les relations de crédit avec effectivité. Cette façon de procéder convoque en retour une appréhension plus holistique des relations de crédit, au-delà des dettes privées.
