The Problem of Legal Regulation of Using Animals for Scientific Purposes: International and Ukrainian Experience

Abstract
The article is devoted to the consideration of the topical problem of legislative regulation of animal research and their use in research activities in the context of international and Ukrainian experience. The authors highlight and characterize the existing animal protection standards used in scientific activities in the European Union, the United States, Canada and in comparison with the legal regulation of animal experiments in China. At the same time, the emphasis is on the legislation on the regulation, first of all, of animal cosmetics testing, as it is in this area that regulations are most widespread. Taking into account the Ukrainian experience, in part 2 of the article the authors describe the state of national legislation in this area and highlight such key issues as, in particular, the availability and competence of controlling and monitoring bodies, recommendations for recovery of animals after research. , the duration of experiments and a number of prohibitions in the academic sphere. There are also examples where animal experiments can be considered cruel treatment. The analyzed material allows us to conclude that in Ukraine there are also standards for the protection of animals that are used for scientific purposes, but, compared to Europe, they are outdated and need to be clarified and developed. It is also important to develop legislation to protect animals from cruelty and to expand its scope, including in the case of experiments. In general, there is a general trend in the world to introduce bans on animal testing of cosmetics, which is manifested in the adoption of relevant regulations both abroad and in Ukraine. Ukrainian legislation in the field of conducting experiments is widely analyzed. The activities of the National Committee on Ethics (Bioethics) and its powers in the field of control over compliance with the legislation on animal experiments are highlighted. The requirements of the legislation to the institutions conducting experimental work and the requirements for the procedure of conducting a scientific experiment are analyzed, as well as the prohibitions that the subjects of conducting scientific experiments and tests on animals are obliged to comply with.
