Abstract
Les choses sacrées au musée sont au contact intime des œuvres. Voilà bien longtemps qu’elles se côtoient dans cet espace particulièrement propice pour accueillir des sortes de choses retirées du commerce. En dépit de l’abandon de cette catégorie dans les classifications des choses et biens, le sacré dans le droit continue d’être un intérêt juridiquement protégé. La propriété culturelle, notamment les régimes spéciaux de domanialité publique, assure cette mise à part du monde. Cela étant, leur charge de sacré varie. En particulier, le corps humain, conservé et exposé au musée sous toutes ses formes, est sans doute au plus haut degré une chose hors commerce. Sa présence dans ces lieux soulève de grandes questions sur la nature des droits et obligations auxquels il donne prise, sur la possibilité même d’une propriété. Les deux couples d’opposition garde versus propriété, choses dans et hors commerce font singulièrement sens dans le champ de la propriété culturelle, dans lequel, selon la formule de Proudhon, l’État « régit, administre, conserve et protège ».
