Abstract
L’Assemblée nationale du Québec a adopté en juin 2019 la Loi sur la laïcité de l’État, après un vif débat qui reflète la trajectoire sociohistorique unique de la société québécoise. Cette loi s’insère dans un régime fédéral marqué par une vision westphalienne de la régulation du religieux et par la reconnaissance graduelle de la neutralité religieuse des pouvoirs publics encadrée par une charte des droits sanctionnée par la magistrature. Si l’on oublie souvent que la laïcité possède aussi un ancrage latino-américain, il reste que la loi québécoise bute sur une contestation judiciaire hautement politisée, qui montre la difficulté pour une minorité nationale, distincte par sa langue, son droit civil et son passé catholique, de mener sa propre politique de régulation du religieux.
