Abstract
Dans l’affaire Bernard Anbataayela Mornah c. République du Bénin et Csrts du 22 septembre 2022, la Cour africaine des droits de l’homme et des peuples a interprété le droit des peuples à l’autodétermination de façon originale, en tenant compte de la place singulière qu’il occupe dans l’histoire du continent. La Cour a reconnu que le droit à l’autodétermination est une norme de jus cogens, faisant ainsi peser des obligations erga omnes sur les États africains afin d’assister le peuple sahraoui et l’aider à se libérer de la domination marocaine. Par ailleurs, la Cour a déclaré ledit droit parfaitement justiciable et, qui plus est, a ouvert la possibilité d’une actio popularis à l’ensemble des citoyens africains. Ces derniers peuvent saisir la Cour pour demander la protection du droit à l’autodétermination sans avoir à justifier d’un intérêt personnel.
