Abstract
É inerente ao próprio conceito de ato administrativo a produção de efeitos jurídicos. Como, então, a autotutela — e, mais especificamente, a decadência da autotutela — impacta os efeitos gerados pelo ato administrativo em questão? O presente artigo defende que os efeitos jurídicos de um ato administrativo que se prolongam no tempo estão abarcados pelo instituto da decadência da autotutela e, assim, se devem ser preservados. Para isso, analisa os fundamentos da decadência da autotutela administrativa, como mecanismo estabilizador das relações sociais e concretizador da segurança jurídica, e delineia a lógica pela qual devem-se preservar os próprios efeitos do ato administrativo em questão. Em seguida, aplica essas considerações para um caso abstrato (porém bastante prático): o reequilíbrio econômico-financeiro de um contrato de concessão por meio de aumento tarifário. No caso, o reequilíbrio é contado a partir do reconhecimento do desequilíbrio financeiro; decorrido tal prazo, o aumento tarifário deverá ser preservado, conjuntamente com o ato em si que reconheceu o desequilíbrio.
