Le chapitre 33 de l’ACÉUM sur les politiques macroéconomiques et questions relatives aux taux de change constitue un nouvel ajout au domaine des accords commerciaux régionaux. Celui-ci n’a donc pas de chapitre équivalent dans l’ALÉNA. Ces nouvelles dispositions semblent avoir été incluses à l’ordre du jour de renégociation à la demande des États-Unis à la suite de multiples manipulations monétaires effectuées au cours de la décennie 2003-2013 et à l’incapacité du Fonds monétaire international (FMI) d’encadrer les dévaluations monétaires compétitives. Bien qu’il ne s’agisse pas d’un problème entre les trois États parties à l’ACÉUM, ce chapitre constituerait un modèle pour de futurs accords commerciaux. L’originalité de l’inclusion de dispositions sur les politiques macroéconomiques et les questions relatives aux taux de change dans un accord commercial régional ne s’étend pas entièrement au contenu de ces dispositions. En effet, la majorité des articles substantifs sont similaires aux dispositions non contraignantes figurant dans les Statuts du FMI. Toutefois, les États parties ont convenu de soumettre les exigences de transparence au mécanisme de règlement des différends de l’Accord, ajoutant ainsi une force de mise en oeuvre qui n’existait pas auparavant dans d’autres fora. L’inclusion de ce chapitre dans l’ACÉUM démontre la volonté de certains États d’inclure de plus en plus de questions non commerciales dans les accords de libre-échange afin de bénéficier des solides mécanismes de règlement des différends qu’ils contiennent généralement. Il reste à voir si le chapitre 33 sera reproduit dans les futurs accords commerciaux.
