Abstract
Esta pesquisa busca compreender a maneira pela qual se dá a construção de sentido em torno da atribuição de (in)capacidade a pessoas com deficiência intelectual no Direito, a partir da análise do instituto da (in)capacidade civil e sua instrumentalização pela ação de definição de curatela. Recorreu-se à revisão bibliográfica e pesquisa empírica sob fonte documental, tendo como objeto autos processuais de ações ajuizadas entre 1971 e 2015, e que tramitaram em duas das Varas de Órfãos e Sucessões da Comarca da Capital do Rio de Janeiro. O método empregado para análise dos dados coletados foi a triangulação quali-quantitativa. De acordo com as práticas judiciárias das varas pesquisadas, observou-se que coube ao perito atestar a capacidade civil, segundo as regras do saber médico. Assim, a deficiência intelectual foi percebida como incapacitante de toda ordem e o interditando encarado como alguém que necessitava ser amparado ao longo de toda a sua vida.
