Abstract
En ce début d’ère «post-COP 21 » , l’idée d’interconnecter les marchés du carbone occupe une place grandissante dans la réflexion sur les stratégies d’atténuation à privilégier. Cette interconnexion est en effet souvent présentée comme une solution pour renforcer l’efficacité économique des marchés du carbone mis en place au niveau national ou infra-étatique. Cependant, mettre en réseau des marchés du carbone est une opération complexe qui suppose au préalable de définir un cadre juridique précis. Or, que nous enseigne la pratique au sujet de l’élaboration, du contenu et de la mise en oeuvre de ce «droit » de l’interconnexion des marchés du carbone ? Cet article propose d’apporter quelques éléments de réponse à cette question à partir d’un examen de la liaison des marchés du carbone québécois et californien.
