Abstract
Hukum Waris yang berlaku di Indonesia sampai saat ini masih belum menjadi satu kesatuan hukum atau belum tercipta unfikasi hukum, hukum waris yang masih bersifat pluralistik akibatnya sampai sekarang ini pengaturan masalah warisan di Indonesia masih belum adanya keseragaman. Anak perempuan dalam masyarakat adat Batak Toba tidak mendapatkan harta warisan berupa harta peninggalan orangtuanya, karena menurut adat Batak Toba kedudukan perempuan dinyatakan bukan sebagai ahli waris. Dalam kasus terjadi gugatan antara anak perempuan Victoria Parhusip dan S.W Simbolon yaitu Veridiana Tiurlan Simbolon melawan Arifin Parhusip, penggugat tidak mengikutsertakan anak laki-laki dari Victoria Parhusip dan S.W Simbolon. Skripsi ini mengangkat putusan pada Studi Kasus Pengadilan Negeri Balige Nomor 47/Pdt.G/2013/PN.Blg. Dengan pokok permasalahan: 1) Bagaimanakah kedudukan anak perempuan dalam mewaris harta asal pauseang berdasarkan Hukum Waris Adat Batak Toba? 2) Apakah putusan Pengadilan Negeri Balige Nomor 47/Pdt.G/ 2013/PN.Blg tentang kedudukan anak perempuan dalam mewaris harta asal pauseang sudah sesuai sudah sesuai menurut hukum waris adat Batak Toba? Metode penelitian menggunakan tipe penelitian normatif, sifat penelitian deskriptif analisis, dengan data sekunder melalui studi kepustakaan, data dianalisa secara kualitatif dan penarikan kesimpulan dengan cara deduktif. Kesimpulan, bahwa Putusan Majelis Hakim Pengadilan Negeri Balige Nomor 47/Pdt.G/2013/Pn.Blg tidak sesuai dengan hukum adat Batak, karena Majelis Hakim membagi harta asal pauseang milik alm. Victroia Parhusip kepada delapan orang ahli warisnya dan tidak memperhatikan terlebih dahulu kedudukan anak laki-laki untuk mewaris harta asal pauseang tersebut.Kata Kunci : Hukum Waris Adat, Harta Asal Pauseang, Kedudukan Anak Perempuan dalam Hukum Waris Adat Batak Toba.
