Abstract

Depuis l’arrêt de la Cour suprême du Canada, Bruker c. Marcovitz, des clauses matrimoniales peuvent traduire des obligations normatives religieuses ou culturelles en obligations valides et exécutoires en mobilisant la doctrine ou notion de justiciabilité. Cette notion, qui repose sur des règles, des normes, ainsi que des principes jurisprudentiels, permet de délimiter le champ d’application de l’intervention judiciaire dans la vie socio-culturelle. Il est ici soutenu qu’elle mérite d’être examinée en droit international privé québécois, car l’articulation entre la justiciabilité et l’extranéité normative permettrait la prise en compte d’une norme étrangère lors de litiges familiaux entre des parties d’origine immigrée. Cette hypothèse est appliquée dans l’analyse du traitement par les tribunaux québécois de litiges matrimoniaux entre immigrants libanais de différentes confessions minoritaires.
