Le droit français des contrats et du régime de l’obligation a été réformé par l’Ordonnance du 10 février 2016, non sans subir l’influence de codifications récentes et de travaux européens. Peu de temps avant lui, le nouveau Code civil roumain de 2009, entré en vigueur le 1er octobre 2011 avait remplacé le Code civil roumain de 1864 jadis fortement influencé par le Code civil français de 1804. En 2011, le droit roumain a, quant à lui, subi une influence plurale, notamment celle du Code civil du Québec (en vigueur depuis le 1er janvier 1994), mais aussi celle des Codes civils français, et italien et du Code suisse des obligations. Dans ce contexte de réforme des droits continentaux, l’Institut de recherche juridique de la Sorbonne (IRJS-André Tunc) de l’Université de Paris 1 (Panthéon-Sorbonne) et l’Université de Bucarest ont constitué un groupe de travail pour comparer leurs nouvelles dispositions législatives en matière de contrat et de régime de l’obligation. Cet ouvrage est le premier tome de ce travail comparatif et concerne le droit des contrats, décliné sous toutes ces facettes. Il permet de connaître la réforme française, tout juste portée sur les fonts baptismaux, tout en la comparant à la grande codification récente qu’a opérée le droit roumain. Il sera suivi d’un second tome sur le régime de l’obligation. Sur chaque thème se succèdent dans la langue de Molière, un rapporteur français et un rapporteur roumain, ce qui permet de faire le tour de tous les choix fondamentaux faits par les deux législateurs. L’ouvrage apparaît ainsi incontournable pour tous ceux qui s’intéressent de près au droit des contrats.
