Abstract
Quebec law on development and town planning entrusts the town planning domain to municipalities. Competence in the matter of regional planning is given to counties regional municipalities and metropolitan communities. Competence in local planning and town planning regulation is confided to local municipalities. The State has however an important part, especially with regard to planning.Main planning instruments provided by the law are, at a regional level, working and development scheme and, at a local level, comprehensive development area maps. Main regulation instruments are zoning, plot and construction maps. There are also some others town planning regulations.Population can be heard before adoption, modification or revision of a working and development scheme, of a comprehensive development area map and of a town planning regulation. The modification of certain parts of zoning and plots regulation, as well as the modification of the conditional uses regulation, might even be submitted to referendum approval.The plan and the town planning regulation, except for the minor exemptions regulation, must be in conformity with the objectives of the working and development scheme and with the provisions of the complementary document which must accompany it. The town planning regulation, except the same exception, must, moreover, being in conformity with the comprehensive development area map.The checking of the conformity of this plan and these regulations is very complex, like the majority of the procedures envisaged by the development and town planning law.
