Abstract
En este estudio se trata de la autonomía privada considerada como un principio general del derecho, y de su recepción en el derecho canónico. En consecuencia, se consideran las principales manifestaciones de la autonomía privada en el derecho canónico, basadas en el ejercicio de algunos deberes y derechos de los fieles; en particular, el derecho de reunión y de asociación, el deber y derecho al apostolado, y su complemento institucional: el derecho a promover y sostener aquellas iniciativas apostólicas que son propias de todos los fieles. El nuevo estatuto jurídico de los fieles ha hecho necesario que el legislador haya buscado también los recursos institucionales para que esas iniciativas puedan llevarse a cabo. Es así como ha surgido un nuevo tipo de personas jurídicas: las llamadas por el Código "personas jurídicas privadas". A través de ellas, los fieles pueden promover asociaciones y fundaciones autónomas con su libre iniciativa, cuyo régimen jurídico se rige por la autonomía privada de los fieles, y da lugar a un auténtico derecho privado canónico.
