Abstract
En 1792, l’Assemblée législative adopte un décret pour encadrer les redditions consenties par les troupes françaises. À travers la codification de la capitulation coutumière, l’autorité révolutionnaire promeut un contrat quasiment impossible à conclure. Cette promotion semble porter une doctrine radicale de la guerre, mais l’analyse de la jurisprudence permet de nuancer cette appréciation. Le droit de la capitulation porte en lui une distinction fine des échelles de la guerre, gage de l’efficacité du commandement révolutionnaire. De plus, la législation sur les capitulations manifeste une définition de la souveraineté qui borne la capacité juridique des généraux, les cantonne au strict domaine de la conflictualité et préfigure « l’état de siège civil ».
