INTRODUCCIÓNLa incorporación del clero diocesano en la Seguridad Social, hecho que tuvo lugar con motivo de la acción generalizadora de la protección dispensada por este sistema en 1977, ha suscitado algu, nas cuestiones que merecen especial consideración, sobre todo si tenemos en cuenta la discordancia que en algunas instituciones presentan la legislación canónica y la legislación laboral.Esto ha ocurrido de manera significativa con el instituto jurídico de la jubilación de este colectivo, respecto del cual, las continuas remi, siones efectuadas por ambos ordenamientos, las evidentes lagunas de regulación y las dificultades técnicas de interpretación, han motivado, en algunas ocasiones, que el clero diocesano se encon, trara en una situación de inseguridad jurídica cuando trataba de acceder a la jubilación debida por los servicios prestados en el seno de la Iglesia.1. El c. 422.1 del ele de 1917 dispone que «los que disfruten de una prebenda únicamente de la Sede Apostólica, pueden obtener el indulto de premio o, como suele decirse, de jubilación, después de un servicio coral laudable continuado durante cuarenta años en la misma o en distintas iglesias de la misma ciudad, o al menos de la misma diócesis»
