A Substituição Tributária do ICMS e as práticas da gestão tributária: estudo de caso em um comércio varejista de alimentos no Oeste do Paraná

Abstract
O ICMS Substituição Tributária (ST) é um imposto de competência estadual, que promove maior eficiência na fiscalização e colabora para a diminuição da sonegação fiscal. Por meio da gestão tributária avalia-se o real custo-benefício, servindo de apoio nas decisões estratégicas. O presente artigo teve por objetivo averiguar como o processo de ressarcimento e/ou complementação do ICMS-ST pode incentivar as práticas de gestão tributária em uma empresa no ramo de comércio varejista de alimentos. A pesquisa foi realizada em uma empresa consolidada no mercado e de grande porte. Em relação a metodologia a pesquisa se enquadrou como exploratória, quanto a abordagem foi qualitativa e quanto aos procedimentos estudo de caso, com a aplicação de observação participante, entrevistas informais e análise de documentos. Os resultados encontrados, demonstram que a empresa desempenha várias práticas de gestão tributária e com isso identificou que não é viável pedir o ressarcimento do ICMS-ST, aderindo ao regime optativo de tributação proposto do Estado do Paraná, onde não requerendo ressarcimento também não precisa pagar a complementação do ICMS-ST.
