A economia colaborativa tem-se afirmado como um modelo de negócio capaz de ditar uma nova interação entre a economia e a sociedade e uma das áreas em que esta interação tem levantado maior preocupação é a da proteção de dados pessoais. Se, por um lado, existe um aumento e uma facilidade da interação entre os sujeitos no tráfico jurídico negocial, e, por conseguinte, dos fluxos de dados pessoais, por outro lado, é importante refletir sobre a proteção dos dados pessoais, enquanto direito fundamental. Neste sentido, importará enquadrar esta nova realidade no panorama legal atual, clarificando em que medida convive a economia colaborativa com a proteção de dados pessoais e desvendando os principais desafios que se levantam, designadamente no que respeita à licitude do tratamento de dados, aos deveres do responsável pelo tratamento de dados e aos direitos dos titulares.
