Recht, plicht, remedie. Bespreking van het proefschrift van mr. W.Th. Nuninga De bespreking gaat over de kern van Nuninga’s betoog. In het buitencontractuele aansprakelijkheidsrecht worden remedies te los van de overtreden norm behandeld. De norm moet sturend zijn voor de keuze van de remedie en maakt de verhouding tussen de verschillende remedies inzichtelijk. Een normcentrische benadering leidt tot meer rechtszekerheid.
