Abstract
There are sizable indigenous populations in several federations around the world, including major settler federations such as the United States, Australia, Canada, Brazil, Mexico and Argentina. Are federations more, or less, hospitable to indigenous peoples than unitary states? While federalism, as a system of territorial self-rule and shared rule, should in theory facilitate indigenous peoples' internal self-determination, this chapter suggests that federal systems also create several institutional and political obstacles to the recognition of their rights and status as self-governing polities. At the same time, innovative federal-like arrangements are emerging in both federal and non-federal countries in response to indigenous claims for greater political autonomy and control over their lands, demonstrating the flexibility of federalism as a mode of organizing territorial authority.
