Abstract
Abstract In the series of Floralia Plant Growers Ltd. v. United Food and Commercial Workers Union (2008, 2015, 2016) cases, a group of Mexican farm workers in British Columbia, Canada, were involved in almost a decade of litigation to enforce organizing rights in their workplace. Attempts to limit the organizing included the decertification of their union, blacklisting of union members by the Mexican Consulate in Vancouver, and recruitment of other workforces to replace unionized workers. Many of these claims were strongly contested by the employer. Migrant workers, who often move between work locations and countries, can also challenge traditional methods of trade union mobilizing, as was the case in Floralia Plant Growers. Comparative data from the MWRD across the six jurisdictions explore rates of trade union representation among migrants and compares this with sector-specific trade union data for each jurisdiction to see if union members are under- or overrepresented compared with national averages.
