Pour défendre en justice les communs naturels, illustrant la solidarité écologique et définis en préliminaire, deux pistes sont envisagées à la lumière du droit civil. La première s’appuie sur une vision traditionnelle, distinguant sujet et objet du droit, et imposant l’existence d’un droit subjectif à défendre. En matière de commun naturel, il ne s’agira pas d’un droit subjectif exclusif, mais d’un droit trans-individuel et indivisible. Quant aux objets concernés, il ne sera pas question d’objets de propriété, mais de choses communes susceptibles d’usage commun. Les atteintes à l’intérêt transversal et à la chose ainsi qu’à son usage commun devraient permettre une action en défense du commun naturel. La seconde piste, plus hardie, dépasse la distinction sujet-objet ainsi que l’intérêt subjectif et s’appuie sur la réparabilité légale du préjudice écologique. Elle développe l’idée d’un intérêt du commun naturel, comprenant à la fois l’intérêt d’une communauté composée d’humains et de non humains (intérêt indivisible et transvivant), et l’intérêt d’un objet commun en lien avec la communauté. La singularité de cet intérêt du commun impose pour sa défense en justice des aménagements procéduraux, notamment en termes de titulaires, de voies d’action et de modalités de réparation.
