Ce texte a pour but de souligner les faiblesses du mécanisme d’appel des décisions du Tribunal administratif du logement (TAL), prévu dans la Loi sur le Tribunal administratif du logement, en insistant sur les conséquences de ces faiblesses dans le contexte actuel de pénurie de logements et de flambée des prix locatifs. Deux axes conduisent cette réflexion. Le premier s’articule autour des caractéristiques du mécanisme de permission d’appel depuis une réforme de la Loi en 1997. Ainsi sont analysés les contours de cette procédure, conçue explicitement par le législateur pour limiter le nombre d’appels. Dans un deuxième axe, le texte se penche sur le clivage jurisprudentiel qui s’est constitué ces deux dernières décennies autour de la question du calcul du délai d’appel. Est commentée de manière critique chacune des deux écoles de pensée. Puis, le texte se penche sur le revirement jurisprudentiel important qui a eu lieu en 2021, et ses conséquences dans la réalité.
