Le présent texte s’intéresse au traitement juridique des familles recomposées et à la place du beau-parent en droit québécois. Dans le but de pousser plus loin la réflexion déjà très étoffée menée par le professeur Goubau sur ce sujet, les auteures utilisent des données issues d’une recherche empirique menée sur la manière dont les conjoints organisent leurs relations au moment d’événements importants de leur vie conjugale. Cette enquête comporte des données relatives à la parentalité et plusieurs aspects concernent les familles recomposées selon que le couple est marié ou en union de fait. Considérant que les familles recomposées font l’objet d’un traitement juridique distinct au moment de la rupture, selon leur statut matrimonial, l’objectif du présent article est de mettre en perspective l’expression « tenir lieu de parent » en se fondant sur les enseignements des tribunaux et de la doctrine pour tenter, par la suite, de déterminer si les critères énoncés par le droit sont concordants ou non avec le comportement et le vécu des familles recomposées.
