Abstract
Syariat Islam sejak semula telah memberikan hak dan peran kepada kaum perempuan di wilayah domestik maupun wilayah publik. Dalam artikel ini, penulis menyatakan sesungguhnya semangat dan pesan moral yang dikandung syariat Islam adalah persamaan derajat antara laki-laki dan perempuan dan berusaha menegakkan keadilan jender di masyarakat. Lebih lanjut penulis berpendapat walaupun pesan universal syariat Islam adalah keadilan jender, banyak penafsir yang memahami teks-teks syariat yang terdapat dalam Alquran dan hadits -- hanya secara tekstual, parsial dan dilepaskan dari konteks turunnya, sehingga menghasilkan interpretasi yang bias jender dan melahirkan aturan dan doktrin ketidakadilan jender. Hasil interpretasi seperti inilah kemudian yang banyak dipahami dan dipraktikkan di masyarakat Islam sehingga menimbulkan diskriminasi terhadap perempuan termasuk masyarakat perempuan di Aceh, khususnya pada masa sekarang ini. Artikel ini juga mengelaborasi lebih lanjut penyebab diskriminasi terhadap perempuan di Aceh yang masih terjadi hingga kini. Penulis berpendapat adalah ironi ketika syariat Islam di era reformasi diterapkan di bumi Serambi Mekah, kedudukan perempuan di Aceh tidak semulia, bermartabat dan tinggi seperti pada masa lalu. Dalam analisisnya penulis menekankan penegakan syariat Islam memang harus didahului dengan pendidikan masyarakat yang memadai serta pemerataan kesejahteraan dan ekonomi yang berkeadilan.
