Abstract
Abstract Malcolm Thorburn describes the innovative step taken by the Canadian legislature in 1983. This early reform of sexual assault law not only abolished the common-law model of rape, but also took sexual assault out of the section on sexual offences and placed it as a subcategory of assault in the Canadian Criminal Code. Thorburn explains the underlying model of consent: consent is seen as a subjective matter, but communicative elements become important if defendants claim to have believed that the other consented: a defence of mistaken belief in consent requires the accused to point to communication or conduct as the basis of this belief. He also discusses the new Canadian approach to fraud (the sexual assault provisions no longer require that fraud is about the nature and quality of the act) and cases that involved severe intoxication of complainants or defendants.
